The UK Judge in his judgement delivered in London on Feb 25, 2021 in the scam accused Nirav Modi’s extradition case has severely indicted and exposed the personal agenda of two retired judges of India who had testified and argued in support of Nirav Modi with oblique motive.
The UK Judge, Sam Goozée has slammed the “evidence” presented by the retired Indian judges namely Abhay Thipsay and Markandey Katju both of whom belong to the Lutyens Lobby. While arguing, Thipsay had claimed that the evidence against Nirav would not meet the criteria of cheating and criminal breach of trust under the Indian law.
The UK Judge was equally dismissive of former Supreme Court judge Markandey Katju’s argument that the apex court was doing the bidding of the Centre and that 50% of judges in India were corrupt. Katju also said Nirav was being blamed for the collapse of the Indian economy as “the Jew of India”, which Goozée described as “astonishing, inappropriate and grossly insensitive comparisons.
Despite having been a former Supreme Court judge in India until his retirement in 2011, his evidence was in my assessment less than objective and reliable,” Goozée said. “His evidence in court appeared tinged with resentment towards former senior judicial colleagues. It had the hallmarks of an outspoken critic with his own personal agenda.
I found his evidence and behaviour… to be questionable for someone who served the Indian judiciary at such a high level.”A bare reading of the above judgement by UK Judge has revealed that both the above retired judges of India have deliberately and intentionally made false imputations against the Indian judiciary particularly Supreme Court for which the Apex Court of India may take cognisance thereof and initiate suo-motto criminal contempt proceedings against them in the overall public interest.
